Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (“User”) and Mitwa (“Company”, “we”, “us”, “our”) governing your access to and use of the Mitwa web application, available at mitwa.in and related subdomains (“the Service”).

By creating an account, clicking “Create account”, or otherwise using the Service, you confirm that you are at least 18 years of age and have read, understood, and agree to be bound by these Terms and ourPrivacy Policy.

If you do not agree to these Terms, you must not use the Service.

Mitwa provides:

• Manual tracking of personal finances including bank accounts, credit cards, loans, investments, and assets
• Mitwa AI — financial insights, chat, and reports — powered by Claude (Anthropic)
• Net worth calculation, spending analytics, and financial health scoring
• Goal tracking and financial planning tools
• Subscription-based access to premium features (Free, Pro, Premium plans)

Mitwa does not connect to your bank accounts, import bank statements automatically, execute financial transactions on your behalf, or provide account aggregation services under the RBI Account Aggregator framework.

Mitwa AI and all features of the Service are for informational and educational purposes only.

• Mitwa is not a SEBI-registered investment advisor under SEBI (Investment Advisers) Regulations, 2013.
• Mitwa is not regulated by the Reserve Bank of India (RBI).
• Mitwa AI responses, reports, and suggestions do not constitute professional financial, investment, tax, legal, or insurance advice.
• You should not make any financial decision solely based on Mitwa's outputs without independent verification and, where appropriate, consultation with a qualified professional.
• Past performance indicators shown in the Service do not guarantee future results.

By using Mitwa AI, you acknowledge and accept that Mitwa's suggestions are automated and may not account for your complete financial situation.

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your password.
• You must notify us immediately at support@mitwaai.com of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for more than 12 months.
• One person may not maintain more than one account on the Free plan. Multiple accounts to circumvent plan limits are prohibited.

5.1 Plans

Mitwa offers Free, Pro, and Premium subscription plans. Features and limits for each plan are described on the Pricing page and are subject to change with reasonable notice.

5.2 Billing

• Paid plans are billed on a monthly or yearly basis in Indian Rupees (INR) via Razorpay.
• Your subscription renews automatically at the end of each billing cycle unless cancelled.
• You authorise Mitwa to charge the applicable fees to your payment method on record.
• All prices are inclusive of applicable taxes (GST) unless stated otherwise.

5.3 Cancellation

You may cancel your paid subscription at any time from Settings. Upon cancellation, you will retain access to paid features until the end of the current billing period. No partial-period refunds are issued except as described in our Refund Policy.

5.4 Plan Changes

Upgrades take effect immediately. Downgrades take effect at the end of the current billing cycle. If you downgrade, features or data that exceed the lower plan's limits may become inaccessible but will not be deleted for 30 days.

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable Indian law
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated tools, bots, or scripts to scrape or excessively query the Service
• Share your account credentials with others or resell access to the Service
• Upload malicious code, conduct denial-of-service attacks, or interfere with the Service's infrastructure
• Impersonate another person or provide false information to circumvent verification
• Use Mitwa AI to generate financial misinformation or to mislead others

Violation of this Section may result in immediate account suspension without refund.

All content, design, code, branding, and materials in the Service are the intellectual property of Mitwa or its licensors and are protected under Indian intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

You retain ownership of all financial data you enter into the Service. By using the Service, you grant Mitwa a limited, non-exclusive licence to process your data solely for the purpose of providing the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

Your financial data is entered manually. Mitwa does not have access to your actual bank accounts or financial institution systems. The accuracy of data and insights depends entirely on the accuracy of data you provide.

To the maximum extent permitted by applicable law:

• Mitwa is provided “as is” without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or complete.
• Mitwa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to financial losses arising from reliance on AI-generated advice.
• Our total aggregate liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid to Mitwa in the 3 months immediately preceding the claim.

Nothing in these Terms excludes or limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Indian law.

We strive to maintain 99% uptime but do not guarantee uninterrupted availability. We may temporarily suspend the Service for maintenance, updates, or reasons outside our control.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Material changes to the Service will be communicated via email or in-app notification at least 14 days in advance where possible.

Either party may terminate this agreement at any time. You may delete your account from Settings. We may terminate or suspend your account if you violate these Terms, upon which your access will cease immediately.

Upon termination, your data will be deleted as described in our Privacy Policy. Provisions that by their nature should survive termination (including Sections 3, 7, 9, and 12) shall continue to apply.

These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be:

• First subject to informal resolution by contacting us at support@mitwaai.com
• If unresolved within 30 days, submitted to binding arbitration under the Arbitration and Conciliation Act, 1996
• Conducted in English, seated in India

Nothing herein prevents either party from seeking urgent injunctive relief from a competent Indian court.

We may update these Terms from time to time. We will notify you of material changes via email or prominent in-app notice at least 7 days before they take effect. Continued use of the Service after the updated Terms take effect constitutes your acceptance.
